Dj-EsiParticipantsome styles of music mainly dance styles uses a lot of samples from films i was just wondering on legal issues with this i know their are some with acapellas as ive read the littel post bit but for films are they royalty free licensed to the films ppl or the perosn who speeks them
was jsut tad curious tbh

Dj-EsiParticipantok cool i will have a look into that jsut alot of film samples are used in gabber or gabba
they use one liners from films or motivational speechs from famous people and have been published on vinyl, albums etc
few i can think off as exampels are these
erm the shinning "heres johnny"
be cool "dont tell me to be cool… i am cool"
stuff like that but cheers for link will have a gander at that later on 😉

JuggernautParticipantyeah they exist…and are typically "whitelabels" of some description. the legality issues as far as vinyl is concerned is sticky..
Hell, i could record all my dvd’s to vinyl (it would cost a bloody fortune mind!) and go to vinyl stores, talk to the manager and get in with a few quid for my troubles.Doesn’t make it legal though.

If your track is based round a sample for a film and it rockets to the popularity of
the charts, your gonna be looking at giving a HUGE % of profits if you havnt cleared
the sample 1st. 100% in some cases.
The film industry earns such mega money they are not gonna be interested in any
sort of negotiations regarding a song release, it will be either give us everything or you dont use it.
I think a bhangra track sampling Night rider earnt no cash from the the track after
a white label took off without sample clearance.But as J mentioned, white labelling stuff is a completely different ball game to commercial

yes he did get sued for the start of 2001 "lolo" before the lowrider bouncing their is the THX music which he didn’t ask to use and got sued i think it got settled out of court though

anisinaParticipantAnything film with dialogue or music still has the same force of copyright as music. The problem with the user is, the movie industry is more protective of how any use of their material happens.
They can always argue "you copied the whole thing" to enable the use, and if you break their end user licence you will be signing over 100% of a royalty.
Furthermore, the film industry pay a lot lot more attention to the underground music scene than most record companies do. Why? Because they want something that fits the scene of the image, rather than fits the image of the scene.
You will be very surprised at who has the real power out there for this type of thing.
Research what a publisher does and how and why.
