jabbampParticipantI was just thinking about this leagal stuff after reading one of the posts in here asking what the legal proceedings would be about getting signed up using others samples.
What I want to ask is, what about us people who are just passing the time and not trying to, or at least not getting signed up? Is it actually ok for us to use these samples and post them seeing as there is no financial gain on our part?
Also, I have noticed that people have videos of thier mashes featuring parts of other artists videos posted on youtube, (something which I am about to do and about to post the link). Is that ok or am I now a criminal?

funkybeatsParticipantNah mate don’t worry about it, you’ll be ok as long as your not making any coin. In the industry there is a saying “where there’s a hit there’s a writ” – This means that if your tune is proper good and gets commercial attention then you will probably find yourself needing to get clearance and you’ll probably end up giving some money to who ever owns the sample… if it is that good though the label the sample belongs to might even sign it!
What you wanna do should be ok like I say, I’ve never heard of anyone getting in shit for sticking their bootlegs online for free and I’ve been online about 10 years.

troutmaniacParticipantTechnically speaking, a mash-up IS breach of copyright. Artists also have what’s known as moral rights, which means they can object to any derogatory treatment of their work. The reality is exactly as funkybeats says it is. Record companies just haven’t got the resources to chase everyone, so they go after the people who’ve made money out of their artist’s work.
The issue of financial gain is irrelevant. If you sample someone else’s work, it is breach of copyright – simple as that.
If they do come and get you, it won’t be a heavy, it’ll be a lawyer. They’ll just tell you to remove the track from the web.

jabbampParticipantAh, thats ok. For one thing it means that there will be a whole lot of people sued before they get to me and for another thing, I am already used to people telling me to get my music off – lol. Basically, its not worth worrying about unless a situation turns up right?
Mind you, I really hope they would not class any music I do as derogatory treatment of their work. My music might not be that good, but that would hurt.

90% of people sample then work out problems if/when they arise.

Hmm, smart idea, but surely they’d spot that one? I would think they have had to deal with this before. Maybe on a small scale, I could see that working out, but it would still amount to copyright breach would it not? Otherwise, that could be done with anything. Like some software which is free for personal use and can be redistributed, but not sold (or altered). It means that you could sell something else and just "add" this product for free, therefore it is not being sold.
But it is still being used to aid personal profit as it is an added incentive for the person to buy. Its like using the product for marketing purposes. That must be still the same thing in one way or another right?
