Seriously, there's no point dreaming of releasing anything commercially with copyrighted 'pellas unless you have some serious connections or serious amounts of money. Or unless you track is absolutely smokin' hot, it could be that the artist/label might release it and give you peanuts for the work, which is fine because you get some credibility in return anyway.

This is all good information. I was always curious about this myself. I've always kept my remixes private and not took any chances making copies (except 4 a few close friends) because of copyright issues.

Unless youre track gets really well known the original artist wont even find out if youve used any of theyre material and if you edit it enough and change it enough i think it should be acceptable anyway

Regarding US law, here's a few truths just to clarify some things...

When an artist writes a song or makes a recording, that artist automatically retains all of the rights to the song. There is no need to register it with the copyright office but that can be done if you want. That is the law.

And that artist retains the right to sell and distribute their song as they see fit. This means that unless you have specific permission (ie. you licensed the acapella from the artist or record label), it is illegal to distribute a song that includes another artists work. That is the law.

In practice, many people don't pay attention to this law and distribute songs that include other people's music or vocals (such as unsolicited remixes). It is illegal but it is done. However, it is considered egregious to sell a song with other people's work in it. That is not cool in any way and will most probably draw attention.

Is posting a remix on a public forum considered electrical distribution?

I hate copyright laws in America. The only reason they have two copyrights (creative and material, right?) is because the record companies had to give the illusion of giving the artists control over their own music, while still controlling some portion of the recording. It's so lame.
