All i know is if your not makin any money off the artists acapella your good to go. But you do want to make money off of the acapella that you used cause its in your creation. then yes you have to get permission. sucks i know but its the law lol
Or...you can back door the thing and release a promotional product that has your "bonus mixtape" packaged with it...just as long as the promo is not tied to the the mixtape in any way, you could be good. I know nothing about copyright law, but read something similar in another forum that seemed like this was a potential loophole in the system?? But if it were me?? Free license on copyrights all the way!

Its actually pretty easy to get around. You might get some hot shot rapper who say's f*** you and has it pulled, but I know Kraddy from the Glitch Mob released an album called "the Illegal Album" comprised of remixes he didnt get permission to sell and he's selling it, no one really cares.

Just to clear up a few misconceptions people have about copyright. In the UK copyright arises automatically and is an unregistered right unlike other forms of intellectual property such as trademarks and patents. With regards music, therefore anything you create will automatically be protected by copyright provided the work is original and it is fixated i.e. recorded. A song would consist of two separate categories of protected works: the literary works i.e. the lyrics and the musical works.
Whilst copyright is not infringed for private non-commercial use; issuing, ‘communicating’ by electronic means or playing any copyrighted works to the public without the permission of the copyright owner(s) would constitute copyright infringement. However for a claim of primary copyright infringement to be upheld the infringement must be in relation to a substantial part of the protected works. It is questionable whether merely using parts of an acapella for example would constitute using a ‘substantial’ part of the works. If you are found liable for copyright infringement the court can either order you to pay the copyright holder what profits you have made or to pay damages which are usually the same amount as what you would have had to pay the owner for a licence to use the work. Either way, its best to ask permission to use the vocals if you plan to circulate your work to a wide audience whether for profit or not. Due to the costs involved in pursuing a claim its more likely to be the big labels that would come after you!

Just a suggestion if your a software producer. Some softwares (if you bought it) gives you the option to record information such as the date, name of the author and then it saves it for you. I've never bought a software in my life but I heard from word a mouth.
^^^ legal nonsense indeed. I just think its like most people have said: if your makin crazy good remixes and their getting played - as long as you're not making any money off of it (or don't appear to be) then its all good.
i think its crap some pop artist sues for royalties and copyright to some song that is a cover of an original 80s hit or an old diva classic. They should really stop and think about what is going on. I have seen the lifestyle of these people do you honestly need 5 cars? Isnt the adoration of your fans and the money they bring to concerts and merch tents?
That being said true artists with original stuff really do need to protect their stuff. Its tragic when some artist dies and years later some young gun thinks they can do it better.
The New Zealand govt is about to pass a law that forces ISPs to cancel internet connections and take down websites ON ACCUSATION of copyright infringement. how s**t is that?
at www.CreativeFreedom.org.nz there has been a song made which is free to download called the "copywrong song" and there is also a remix competition. All the details are on the website, you guys should all have a go at remixing it.
how about if u post a minimix on myspace ... is that ilegal ?? i mean ..it not like your gonna get some money for them ... its just for fun .and the owner of the songs should be thankfull for the promo...
the reality of it is, unless you're shifting huge numbers (a rare thing in more underground music) it's very rare any copyright owners are gonna come looking for you for their share of a few hundred quid you can potentially make out of a release, most labels will put stuff out without worrying about it...if you've got a hit on your hands and you're gonna be shifting a significant amount of copies, then's the time to go clearing samples..
technically if you use any part of a song and use it without being given an individual license to do so you're in copyright infringement.
copyrights are anyway just like when tape decks came out that could record--the funny thing is its not illegal to record it off the radio unless they imply it is and i never hear a radio station say that
